ASSUMPTION OF RISKS
I am aware that HOCKEY and SKATING (the “Activity”) involve many risks, dangers and hazards including, but not limited
to: cuts from sharp objects such as skates; paralysis; objects hitting the user; the conditions of the ice on or beneath the
surface; variations in the ice surface; collision with other persons; collision with objects; loss of balance or control; slips,
trips or falls; accidents during practice or games; infectious diseases contracted through viruses, bacteria, parasites, and
fungi which may be transmitted through direct or indirect contact; negligent first aid; failure to act safely or within one’s
own ability; negligence of other persons; and NEGLIGENCE ON THE PART OF THE RELEASEES. I UNDERSTAND THAT
NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR
PROTECT ME FROM OR WARN ME OF THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE. I am also aware that
the risks, dangers and hazards referred to above exist throughout and beyond the ice rink and that many hazards are
unmarked. I FREELY ACCEPT AND ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF
PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
In consideration of the Releasees accepting my application to participate in the OKJR Hockey Club and permitting my use
of the hockey rink and other hockey facilities (hereinafter the “premises”), I hereby agree as follows:
2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all liability for any damage to property or personal
injury to any third party, resulting from my participation in the Activity and my or my child(ren)’s use of or presence
on the premises;
RELEASE OF LIABILITY, WAIVER OF CLAIMS,
ASSUMPTION OF RISKS, INDEMNITY AGREEMENT AND
EMERGENCY CARE PERMISSION
(hereinafter referred to as the “Release Agreement”)
BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE
RIGHT TO SUE FOR NEGLIGENCE, BREACH OR CONTRACT OR BREACH OF THE OCCUPIERS LIABILITY ACT
OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT
PLEASE READ CAREFULLY!
1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES, and TO RELEASE
THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I or my
child(ren) may suffer, or that my next of kin may suffer, as a result of my my child(ren)’s use of or my or my
child(ren)’s presence on the premises DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF
CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE UNDER THE OCCUPIERS LIABILITY ACT,
R.S.B.C. 1996, c. 337 ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES THE FAILURE
ON PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM OR WARN ME
OF THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE.

3. Injuries received while participating in the Activity may be compounded or increased by negligent rescue, operation,
or procedures of the Releasees, and I HEREBY ACKNOWLEDGE that this Release Agreement extends to all acts of
negligence of the Releasees, including negligent rescue operations and is intended to be as broad and inclusive as is
permitted by law and, if any portion of this Release Agreement is deemed invalid, illegal, or unenforceable in any
respect, the validity, legality and enforceability of such provision or provisions shall not in any way affect or impair
the validity, legality or enforceability of the remaining provisions contained herein;
4. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns
and representatives, in the event of my death or incapacity;
5. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall
be governed by and interpreted solely in accordance with the laws of British Columbia and no other jurisdiction; and
6. Any litigation involving the parties to this Release Agreement shall be brought solely within British Columbia, and
shall be within the exclusive jurisdiction of the Courts of British Columbia.
EMERGENCY CARE PERMISSION
I FREELY ACCEPT AND ACKNOWLEDGE that it is my responsibility to provide for my or my child(ren)’s own accident and
health coverage while participating in the Activity. In the event that I cannot be reached and/or I am incapacitated or
otherwise unable to give consent, I GIVE PERMISSION FOR EMERGENCY MEDICAL, SURGICAL AND HOSPITAL
TREATMENT and procedures to be performed by a licensed physical or hospital, when deemed immediately necessary
to safeguard my or my child(ren)’s health.
I hereby release the Releasees of any and all responsibility for action(s) taken by the doctor(s), hospitals, or other medical care providers in the treatment and attendance of me or my child(ren).
In entering into this Release Agreement, I am not relying upon any oral or written representations or statements made
by the Releasees with respect to the safety of the Activity other than what is set forth in this Agreement.
I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS
AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS,
ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
